If anyone can refer me to any books, websites, etc. for the medical legal information on medspas in CA, I'd appreciate it. Looking to start a medspa up within a year. Although I've been working as a laser nurse for a plastics/derm office and several medspas i just want to make sure I have all my bases covered. thanks.

I am a physician in CA looking for the same legal information that you are. . . be careful! If you interview a lawyer on the phone about their knowlege of the business they think they can handle it and will talk around the issue saying things like: "any attorney who says they are a "medispa" attorney is just hungry". I just wasted an hour's fee with an attorney who said on the phone he could handle my issues (legal paperwork for physician-RN relationship) and he gave incorrect advice--worse yet, thinking he was right. Problem is, they think they understand CA Medical board and all medical legal issues, but they don't. I am going to use attorneys who other RN's have already gone through. This comment is for anybody that can help, and also more specifcally Sheryl A. Haggerty. I was wondering if you wouldn't mind also sharing with me the information that you were going to share with Izrnurse. I am posting this comment on behalf of my employer. My boss would like to open a medical spa, however she is not an MD nor does she work in the medical field. Her plan was to partner with an MD and have him oversee all proceedures while she worked as management. She is experienced with business management. Is it legal for her to do this? If so, how much of the business can she legally own, 100%, 51%, 50%, ect? Moreover, if anybody has any useful information pertaining to medical spas and legal issues, please let me know; ex. useful links or things I should be looking for. I am barely starting to gather information so even the most basic information would be helpful. Thank you very much for your time and have a nice day.

Along the right side is an area called Categories & Topics. Towards the top is a category called Medspa Legal. There are 34 posts there. Along with the discussions in this forum area you should be able to find quite a bit of information about what is legal and what is not when opening a medical spa. However, you'll also want to talk to a lawyer.
