CAN LPN'S LEGALLY ADMINISTER FILLER INJECTABLES (PERLANE, JUVEDERM) IN THE UNITED STATES? IF SO, AND IF NOT, WHERE???

Dear Wow: Each state has different rules and regulations on this subject. It would be best to check with the nursing board and medical board of the state you are intending to work in. In virtually all states the nurse must be acting under the supervision of a physician. Many states allow only R.N.s to perform these procedures, and only then under strict and specific standing orders and written prescriptions.

Just because a lot of people are getting away with these activities does not mean that the industry is "unregulated". In most states there are are surprisingly detailed and tight regulations for performing any treatments utilizing lasers or IPLs. The administration of injectables is subject to similar scrutiny. While many people are choosing to ignore these rules and regs, if someone complains to the local nursing or medical board the authorities often come down pretty hard. I know-- it happened to one of my nurses. And it was not fun. I have also seen cases against individual nurses reported on various web sites. People are losing their licenses and sometimes their ability to earn their livelihood as a result of performing some of these activities without following the applicable regulations.

In Florida, an LPN could administer injectables under the supervision of an MD/DO or PA/NP as long as the MD/DO or PA/NP has seen the patient and given the order for it to be administered.

This depends on the state you are domiciled in. Check with your state board. Also this also depends on if your malpractice carrier will cover for the injectables correctly. Always read the fine print on this. Some policies may cover you as an employee yet may not cover you as an owner if under HPSO. Which for an LPN can be $300 annually. Hope this helps.
