Medspa Legal & Legislation > South Carolina laws for Med Spa's

Can anyone shed some light on setting up a Med Spa in SC? And what can or can't an RN or an Aesthetician do when the doctor is NOT on premises? ANY help is greatly appreciated!

I could sure use some guidance on this as well. I called the board of nursing before moving here and thought that I was "clear" and understood that if I wanted to do Botox or fillers etc, I needed a physician "accessible". When I asked to clarify accessible, I was just told again, accessible and that they weren't attorneys. I decided not to do Botox etc. but to stick with facials and micro needling. I've been working for 2 months independently and doing really well. NOW, the board of cosmetology says I need to go to esthetician school or get a medical director within 5 miles... This because basically the laws are so vague. I'm so frustrated and confused!!!

I am currently a RN looking to possibly open a spa after getting my Esthetician license (still trying to find a part-time program that fits my current work schedule.) I'm trying to find out what exactly a Registered Nurse Esthetician can do that a regular Esthetician can not. Any idea where I could find this? Any help would be greatly appreciated. North Carolina is also an option giving I live on the state line.

Does anyone have any medical director agreements that I could look at. I would so appreciate it.

For the RN, I can speak to aesthetic devices in NC. As long as you have a medical director and have been trained on a device (North Carolina) you can operate a large majority of them. Same for injectables neurotoxins/fillers and things like Aquagold. Having a Med Director can also provide more access to medical grade skincare products. But, if you do not have a Med Director, your scope of practice is much more limited. I believe you can do the following: certain chemical peels, micro-stamping (not microneedling like with SkinPen or Exceed) permanent make-up, Aqua-delivery systems like Hydrafacial or Skinwave, and eyelash extensions. There are probably other non-Med Director services, but these are the examples I see offered the most. I would look at joining AmSpa, as they will assist with the laws in each state and compliance. They also provide great resources for things like opening medspas, retail placement, providing consults, selling your services successfully, etc.
