Hello,

Assuming SB1423 passes, and it requires direct presence of Dr in Med-spa, what will happen to all these med-spa's currently owned by mostyly women?

does anyone know when the law passed in florida, how it affected the existing business that were own by a non-physicians?

I would say that they would give them a certain amount of time to become compliant with the law. Those that did not would be closed down.

That is the logical approach.

However, the florida law is also attacking physician that are not plastic surgeons or dermatologist. Since the physician license allows the doctor to practice medicine "period", this law should be challenged.

The law does not say med spa's have to be owned by a doctor. In Florida we are able to have non doctor owned facilities since we are a corporate practice of medicine state. A corporation can hire a doctor for the facility. The law only mandates that the doctor must now be a derm or plastic if the primary practice is skin care.
Actually I read that law and that is not what it says.

MD, would you mind citing the lines of the bill that says that a med spa has to be owned by an MD/DO?

I can't find that line in either SB1423 or HB699.

look at it like this. You would agree with me that the law states that if a practice is primarily focused on skin treatments it has to be owned by or you have to have a Plastic surgeon or Dermatologist full time.

I believe that much of it is correct.

Well from here it is logic.

1. If a doctor visits with a patient, he owns that chart. Hipa does not allow anyone else access to that chart when the doctor leaves. In other words he can take his patients with him.

2. If a doctor leaves the practice, who is going to treat the patients? You can't do it without a doctor.

3. Have you looked up how much the salary of a plastic surgeon or dermatologist is these days. Do you really think a doctor is going to work for someone when they can do it themselves? Or, if they did do you think the plastic surgeon would come cheap?

It's common sense.

I don't think that the a Medical spa needs to be owen or operated by a plastic surgeon or a dermatologist. I think any physician properly trained in cosmetic skin care can and should be allowed to do this.

MD, I agree with everything you posted above. But when it gets down to it, the spa in "corporate practice of medicine states" can be owned by a non MD/DO.

I recently had to replace a director that was not working out, so interviewed derms and plastics. Your right, they are expensive. However, some are willing to do it for the referral business, to have a second office, increased exposure, or something to do in early retirement. In my area of Florida, I placed a job ad for a derm/plastic director and in a week I had over 30 applications.

The Dr. may own the charts but who has the pt's loyalty? The provider. So worse case senario the "provider" gets a new director, new charts created and keeps going.

I make sure my director is not located in my surrounding area. People are not going to travel 30 miles to get tx from someone they don't know and typically at higher prices.

So, how much does owning the charts really mean? If your the doctor and doing the procedures then the owner is on shaky ground.


So to respond to your posts: 1) create new charts 2) get a new doctor and keep tx pts. 3) Expensive yes, but still can find the right fit.

I agree with your feelings that any doctor should be able to do/supervise aesthetic procedures. The new law is crazy.

This is my situation- I have a derm who is interested in coming to my spa. I am a Spa Director at a Private Day Spa at a prestigious country club. The spa is only for members, so it is a convenience issue for the members- they pay a lot of $ to belong to the club, and expect the best. If this works the way we want it, my derm would come out on Saturdays with his laser and Botox/Restylane- his nurse would do IPL and he would do the injections. These things would never be done when he was not there. But I don't know if we would have to have him be our medical director. I am not sure how to go about this. Also- would it matter if he left early and the nurse was still there with his laser treating people for an hour? I really want to do everything the right way and before I present to him the % and money issue I want to have all the answers. Maybe you have suggestions or thoughts- I know I would need a lawyer of course- but it is better to talk to people who have experience with this on the beginning to know how to go forward.

I forgot to say that I do know this Dr. very well because I worked for him until I took this job a month ago- I was one of his aestheticians. So he is interested, partly to help me out, but of course to get patients for his practice and to make money. I am not at all concerned about losing people for facials and things like that to his office because of his location vs the club. It would be too far for them to go there regularly for facials and waxing, but not too far for them to go as a patient for dermatologic issues. So for both of us it would be a great situation. I was reading some of the other posts on here and there seems to be a lot of tense posts between owners who are not MDs and the MDs. As an aesthetician, I do not in any way want to do any medical procedure that I am not licensed to do.

What I would like to know is, what is the time frame for all the medspas currently existing under varios MD supervision to comply with this new law? It was not clearly defined . You are right about challenging this law from the physician point of wiew . Unless you have some one else doing the job for you should be able to do these procedures any location yourself. Magda

I thought genesis was totally safe and thought a physician would be available if ever needed since "physician-based" is plastered all over Dermacare's web page. After receiving a severe 3rd degree burn from their RN mid face and requesting medical attention I was ignored medically. I had to seek my own acute care.
