Medical Spa Business Forum > Independent contractor (RN) under different brand

I am a doctor with a medical spa and my own clients. Recently I found an RN who would like to use my space but operate under his own brand name. What is a typical business agreement in terms of profit share, and a typical contract duration? My primary concern is that all of his clients would be his and leave once he does.

There are a few problems, first can an RN practice independently in you state, if not its likely they will be under your license so any complications on their part come to you as well.

It is fee splitting to share profits, so that is a problem. It is not safe to state that the split was the cost of rent, in the worst scenario if there was an investigation they would look into the money paid vs the average cost of renting a room in a med office. ( Gastroenterologists just had this, they had anesthesiologists in their outpatient suites and collecting large fees stating it was rent. In some instances an investigation noted the anesthesiologist was renting 200 sq feet at NY rates $35.00/ per yet they were collecting $100,000. Some were sanctioned some were placed on probation.

THe hourly wage works best.

I also believe there could be patient loss on both sides. So be wary.
