PAT, In GA an MD cannot be employed by a nurse. I am afmiliar with at least one NP-owned Medspa, but not sure of the structure setup.
Although I cannot offer legal advice, my initial impression of this question is that there is not an outright ban on physicians being employed by nurses. There are, however, some contexts in which the law specifically prohibits it--for example, when an MD supervies an NP under a Nurse Protocol Agreement, the MD cannot be an employee of the NP, subject to a couple of exceptions. However, it may be possible to structure the arrangement such that it would not violate the Georgia code and regulations. One idea to look into might be for the physician to be an independent contractor, rather than an employee.
Without knowing more, it is really impossible to say whether the relationship violates Georgia law. If you want to discuss further, feel free to email me.
